Official Rules
I. NAME OF PROMOTION: Tommy Bahama Home $10,000 Dream Room Promotion (the “Promotion”)
II. SPONSOR AND ADMINISTRATOR: This Promotion is sponsored and administered by Lexington Home Brands (the “Sponsor and Administrator”). The Tommy Bahama Home store is owned and operated by Lexington Home Brands, 1300 National Highway, Thomasville, NC 27360. Tommy Bahama Group, Inc. is not a sponsor or administrator of this Promotion.
III. ELIGIBILITY: To be eligible, entrant must be at least 18 years of age, a resident of the state of California, and able to provide proof of age and residency. Employees of the Sponsor and their immediate family members are not eligible. By participating in this Promotion, all entrants agree to be bound by these Official Rules and agree that decisions of the Sponsor will be valid and binding in all respects. The Sponsor is not responsible for incomplete, inaccurate or invalid entries. Copies of all entry forms submitted for verification will become the property of the Sponsor and, by completing the Promotion Registration (as defined below), all entrants consent to the limited use of information provided on the form by the Sponsor but will have the ability to opt out of any subsequent e-mail correspondence.
IV. HOW TO ENTER: No Purchase Necessary. Registration begins November 19, 2022 at 10:00 am PST and ends on January 15, 2023 at 6:00 pm PST. To enter the Promotion, consumers may complete an entry form the Tommy Bahama Home store during regular business hours, located at 73-540 El Paseo, Palm Desert, CA 92260, or by registering online at www.TBfurniturePalmDesert.com (“Promotion Registration”). Upon completing the Promotion Registration, entrants will receive one (1) entry in the grand prize drawing (the “Grand Prize”). Maximum of one (1) Promotion Registration per person will be accepted, regardless of entry method. Any effort by an entrant to misrepresent themselves through the use of aliases or multiple email addresses or telephone numbers or misrepresent their eligibility age, residency or identity will disqualify that entrant.
V. WINNER SELECTION AND NOTIFICATION:
Grand Prize Drawing: A random drawing of Grand Prize entries will be made on or about January 17, 2023. One (1) potential Grand Prize winner will be drawn at random. The potential Grand Prize winner will be notified via email or phone within 48 hours of the drawing. The potential Grand Prize winner will have seven (7) days to claim their Grand Prize by responding to the email notification by the Sponsor, after which they will forfeit the Grand Prize and have no further claim to the Grand Prize. Sponsor will then award the Grand Prize to the next entrant selected in the random drawing. The Grand Prize cannot be transferred, substituted, or redeemed for cash. Upon acceptance of a Grand Prize, the Grand Prize winner shall be deemed to have waived all claims against the Sponsor arising out of entry in the Promotion.
VI. PRIZES: Grand Prize (maximum of (1) one): The Grand Prize is a $10,000 gift certificate to be used exclusively for the purchase of any furniture in the Tommy Bahama Home store located at 73-540 El Paseo, Palm Desert, CA 92260 (“the Store”) at the prevailing retail selling price in the store at the time the furniture is selected. Special order items currently available for purchase through the Store will be included. The Grand Prize winner will also receive in-store interior design services from Tommy Bahama Home, which are always complimentary. The Grand Prize winner will have until May 1, 2023 to use the gift certificate, after which the balance remaining on the gift certificate will expire. All tax liabilities and delivery charges on furniture items will be the sole responsibility of the Grand Prize winner. Winner will receive a Form 1099.
VII. ODDS OF WINNING: The odds of winning a prize will depend upon the number of eligible entries received and are subject to the selection of the winning entry as described in Paragraphs III, IV, V.
Notice: This Promotion is void where prohibited by law. By participating in this Promotion, to the greatest extent permitted under the law, all entrants release and agree to hold harmless the Promotion Releasees (as defined below), and each of their respective attorneys, affiliated officers and directors, representatives, and agents from any and all liabilities for any injuries, losses, or damages, including death, and property damage arising in whole or in part, directly or indirectly, out of participation in this Promotion or acceptance, possession, use or misuse of the prize. The term “Promotion Releasee” shall collectively mean the Sponsor and Tommy Bahama Group, Inc., and each of their respective parents, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional and judging agencies.
IX. WINNERS: The name of prize winners may be obtained at the conclusion of the Promotion, and for a period thereafter of up to 60 days by sending a first class stamped, self-addressed envelope to Lexington Home Brands, 1300 National Highway, Thomasville, NC 27360. Attn: Marketing Department.
X. DURATION OF PROMOTION: This Promotion will commence on November 19, 2022 at 10:00 am PST and conclude on January 15, 2023 at 6:00 pm PST.
XI. ADDITIONAL RULES AND RESTRICTIONS: By participating in this Promotion, entrants agree to abide by and be bound by the Official Rules and the decisions of the Sponsor, which shall be final in all matters relating to this Promotion. The decisions of the Sponsor, and any entity selected to represent the Sponsor regarding this promotion, are final and binding in all respects. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Promotion as solely determined by Sponsor. In the event an entrant wins a prize and is later found to be in violation of these rules he/she will be required to forfeit the prize or to reimburse Sponsor for the stated value of the prize. False, fraudulent or deceptive entries or acts shall render entrant’s ineligible for any prize. Sponsor is not responsible for any typographical or other errors in the printing or advertising of the offer, administration, execution, or announcement of the prizes or prize winners.
XII. IN CASE OF DISPUTES: By participating, each participant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Promotion shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of California; (2) any and all claims, judgments, and awards shall be limited to actual out-of- pocket costs incurred and not attorney fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, or consequential damages, or any other damages other than actual out-of-pocket expenses, or any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with this Promotion, shall be governed by, and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of California.
